The British Flower Delivery Shipping, Returns - Terms & Conditions
General Terms & Conditions:

This is a list of general Terms & Conditions. They apply whenever you are buying from or doing business with British Flower Delivery. We are a reasonable company but obviously for all concerned there must be guidelines to follow for good business relations, so here they are:

These terms apply to British-Flower-Delivery.co.uk, hereinafter referred to as “British-Flower-Delivery”, and to agreements concluded between British-Flower-Delivery and the buyer. Special Conditions, which deviate from British-Flower-Delivery general terms, are only binding if they agreed upon in writing. Offers and quotations made by British-Flower-Delivery are always without engagement. An agreement is termed as “Concluded” at the acceptance of a buyers order by British-Flower-Delivery.

Unless the buyer specifies special quality standards, British-Flower-Delivery will meet the requirements with trade quality. Each agreement is concluded solely in the judgement of British-Flower-Delivery, is considered to be sufficiently credit-worthy. If it is impossible to deliver the order type, British-Flower-Delivery has the right to deliver a type, which is as similar, or to cancel the order. Packing will take place in a manner determined by the trade and is determined by British-Flower-Delivery in accordance with trade practice, unless agreed otherwise

Prices:

The prices shown on the online store are not inclusive of VAT. VAT is added to the total cost of the invoice in the checkout as well as any other costs stated by British Flower Delivery. * Prices quoted on the British-Flower-Delivery price list are for delivery within 2 days of ordering. Orders for delivery out with this period are subject to current prices and availability and are binding, including price increases introduced at the will of British-Flower-Delivery. Costs arising from additions to and/or changes in the agreement are at the expense of the buyer.

Delivery Times:

* Stated times of delivery are approximate. The delivery time specified is in the expectation, that delivery is not hindered and usually for delivery within two days of ordering. Reasonable delay in the time of delivery is not the fault of British-Flower-Delivery. British-Flower-Delivery are only in default for a delay in the time of delivery after written notifications served by recorded delivery. Times of delivery only commence from the moment that all the necessary information is supplied by the buyer, for the proper execution of an order. * Delivery, unless otherwise agreed, or stated, is free of charge to the buyer for orders sent direct from Holland and for all other orders shipped form the UK, there is a charge per box of £4.75. See minimum order levels for direct delivery from Holland and charges per box for delivery in the UK. Where delivery is free of charge, the risk to the products is transferred to the buyer upon delivery.

If the buyer has not taken up the ordered products at the agreed time and place, any loss in quality, if any, resulting from their storage is at the buyer’s risk and expense. If the buyer fails to take delivery after a limited storage period, which is reasonable in view of the type of product, the buyer automatically cancels the order. In that case, British-Flower-Delivery are entitled to sell the products in question. The defaulting buyer is obliged to accept the cost of the difference in price caused by such a sale. British-Flower-Delivery at all times reserve the right to deliver goods C.O.D. after having informed the buyer of this. British-Flower-Delivery also reserve the right to refuse to fulfil orders if the buyer has failed to pay for previous deliveries within the term of payment agreed. British-Flower-Delivery are not liable for any damage or loss incurred by the buyer because of non-delivery.

Complaints:

Report any complaints to British-Flower-Delivery immediately after they have been detected and within 24 hours of receipt. Send any complaints made by telephone in writing (by mail or email) to sales@british-flowers.com within three days of receipt of the products.

A note of the complaint must be recorded on the relevant transport documents when delivered to confirm there was a problem with the goods when delivered. The buyer should store the products, with reference to which a complaint is made, carefully and in such as way that loss of quality is avoided. Permission for return shipment does not imply an acceptance of the complaint by British Flower Delivery.

Returns:

Report any complaints to British-Flower-Delivery immediately after they have been detected and within 24 hours of receipt. Send any complaints made by telephone in writing (by mail or email) to sales@british-flowers.com within 24 hours of receipt of the products.

Any returns must be verified by British Flower Delivery before a refund for your order or replacement will be given.  Every request for a refund or replacement will be assessed on an individual basis to assure customer satisfaction.

Payments:

Payment by first time wholesale customers must be made within 3 days, return wholesale customers within 14 days and non-wholesale customers by credit card. British-Flower-Delivery are entitled to, in case of unpaid cheques to charge the buyer all costs involved. The buyer is in default simply by exceeding the agreed term of payment, without any notification being required for this. The sum owed by the buyer is claimable immediately and without any notification in the event of the buyer’s definite bankruptcy, liquidation, or the buyer is in default for payments towards British Flower Delivery. British Flower Delivery retain the right to invoice, per partial delivery, orders fulfilled in instalments.

Liability:

Compensation paid by British-Flower-Delivery for any damage, which may be suffered by the buyer, shall be not higher than the invoice value of the delivered goods. Complete or partial failure of the cultivation or complete or partial decay during storage, for whatever reason, releases British-Flower-Delivery from his further obligations unless this is an act of gross negligence, in which case British Flower Delivery may send a new delivery. A shortcoming in performance cannot be attributed to British-Flower-Delivery in the event of diseases and plagues, failed harvest, growth defects, exposure damage, war, impending war, strikes, fire, extreme weather conditions, acts of god, government regulations and other circumstances which are beyond British Flower Delivery’ direct sphere of influence. If, as the result of a circumstance as meant in the last paragraph, delivery cannot be made in accordance with the agreement, British Flower Delivery must report this to the buyer by telephone as quickly as possible. Further execution of the agreement will then take place after mutual consultation. If the situation of force majeure occurs while the agreement has been partially completed, British Flower Delivery are entitled to claim payment from the buyer for the deliveries which have already been made. For all products delivered by British-Flower-Delivery applies that they are solely for decorative purposes and not for internal use.

Cancellation:

If the buyer fails in any way whatsoever in the fulfilment of the agreement in question or a previously realised agreement, the buyer will already be in default without any notification being required. That stated in the last paragraph if also applicable in the event of bankruptcy or suspension of payment or receivership of the buyer or the closing down of his business.
